In addition to SPDs, SMMs, and SARs, health care reform added another acronym to the list of "summary" disclosures that group health plans must distribute. The new rules will require that employer health plans provide a uniform "summary of benefits and coverage" (SBC) to all plan participants and beneficiaries. The agencies charged with implementing the law have just issued final regulations (and related guidance) on the SBC requirement. Although this latest guidance gives plan administrators and insurers some additional time to draft and distribute these SBCs, prompt action will be necessary to draft compliant SBCs in advance of the compliance deadline.
In this webinar, Julia Vander Weele and Chadron Patton of Spencer Fane Britt & Browne LLP will provide an overview of the new SBC disclosure rules and summarize the final regulation. Topics will include timing, covered plans, distribution, penalties and the content and format of the notices. The goal is to help prepare employers to comply with this requirement well in advance of their next open enrollment season.

Julia Vander Weele, a partner with Spencer Fane, practices in the firm's Employee Benefits Group. She is also a member of the ERISA Litigation Group. Prior to joining Spencer Fane, Julia worked as in-house counsel for Fortis Benefits Insurance Company, where she managed ERISA litigation and advised senior management on other ERISA issues related to group disability, life, and dental products. She was also a Judicial Law Clerk for the 7th Judicial District of Iowa. Julia's practice focuses on ERISA and other laws governing employee benefits, including matters affecting pension, profit sharing, 401(k), cafeteria plans, and welfare plans. She has had significant experience providing employer training on HIPAA and ERISA issues, and has had substantial involvement in matters dealing with retiree health coverage and bankruptcy.
