Employee leaves of absence raise a number of difficult questions under federal employment laws.  Must a requested leave be granted?  Under what conditions?  Must the position be held open so that the employee may return to it after the leave ends?

Apart from these difficult employment questions, benefits managers must also address the benefits-related aspects of any leave of absence.  For example, how does an employee on unpaid leave pay for medical benefits that were previously paid by salary reduction through a cafeteria plan?  Federal laws, including FMLA, USERRA, COBRA and even ADA can further complicate employers' tasks.
